{"id":8309,"date":"2025-12-31T17:24:35","date_gmt":"2025-12-31T17:24:35","guid":{"rendered":"https:\/\/microvibenews.com\/?p=8309"},"modified":"2025-12-31T17:24:35","modified_gmt":"2025-12-31T17:24:35","slug":"european-human-rights-court-questions-uk-decision-to-strip-shamima-begum-of-citizenship-shamima-begum","status":"publish","type":"post","link":"https:\/\/microvibenews.com\/?p=8309","title":{"rendered":"European human rights court questions UK decision to strip Shamima Begum of citizenship | Shamima Begum"},"content":{"rendered":"<p><\/p>\n<div>\n<p class=\"dcr-130mj7b\">The <a href=\"https:\/\/www.theguardian.com\/law\/european-court-of-human-rights\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">European court of human rights<\/a> has questioned the UK government over its 2019 decision to remove Shamima Begum\u2019s British citizenship.<\/p>\n<p class=\"dcr-130mj7b\">Lawyers in Europe have asked how Begum\u2019s treatment complies with the UK\u2019s responsibilities to victims of trafficking.<\/p>\n<p class=\"dcr-130mj7b\">The intervention has encouraged Begum\u2019s lawyers and fuelled Conservative and Reform accusations of meddling by foreign judges and their calls to leave European human rights treaty.<\/p>\n<p class=\"dcr-130mj7b\">In 2015, as a <a href=\"https:\/\/www.theguardian.com\/world\/2015\/feb\/20\/fears-london-schoolgirls-isis-syria\" data-link-name=\"in body link\">15-year-old schoolgirl<\/a>, Begum left her east London home and travelled with two friends to live under territory held by Islamic State (IS). She was \u201cmarried off\u201d to an IS fighter with whom she had three children, all of whom died in infancy.<\/p>\n<p class=\"dcr-130mj7b\">In 2019, the then home secretary, Sajid Javid, revoked her citizenship on grounds of national security, in a decision <a href=\"https:\/\/www.theguardian.com\/uk-news\/2024\/feb\/23\/shamima-begum-loses-appeal-against-removal-of-british-citizenship\" data-link-name=\"in body link\">upheld in the court of appeal last year<\/a> and backed by the current government.<\/p>\n<p class=\"dcr-130mj7b\">Campaigners and Begum\u2019s lawyers argue she was the victim of child trafficking. Begum, now 26, remains stateless in a Syrian refugee camp.<\/p>\n<p class=\"dcr-130mj7b\">A document published by the European court this month confirms that Begum is challenging Javid\u2019s decision under Article 4 of the European convention on human rights \u2013 a prohibition of slavery and forced labour.<\/p>\n<p class=\"dcr-130mj7b\">The case was lodged in December 2024, after she was denied the chance to challenge the removal of her British citizenship at the UK\u2019s supreme court.<\/p>\n<p class=\"dcr-130mj7b\">Among four questions posed by judges in Strasbourg to the <a href=\"https:\/\/www.theguardian.com\/politics\/home-office\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Home Office<\/a>, they asked: \u201cDid the secretary of state have a positive obligation, by virtue of Article 4 of the convention, to consider whether the applicant had been a victim of trafficking and whether any duties or obligations to her flowed from that fact, before deciding to deprive her of her citizenship?\u201d<\/p>\n<p class=\"dcr-130mj7b\">Birnberg Peirce Solicitors, which is representing Begum, said the court\u2019s communication \u201cpresents an unprecedented opportunity\u201d for the UK and Begum to \u201cgrapple with the significant considerations raised in her case and ignored, sidestepped or violated up to now by previous UK administrations\u201d.<\/p>\n<p class=\"dcr-130mj7b\">One of the lawyers, Gareth Peirce, said: \u201cIt is impossible to dispute that a 15-year-old British child was in 2014-15 lured, encouraged and deceived for the purposes of sexual exploitation to leave home and travel to [IS-controlled] territory for the known purpose of being given, as a child, to an [IS] fighter to propagate children for the <a href=\"https:\/\/www.theguardian.com\/world\/islamic-state\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Islamic State<\/a>.\u201d<\/p>\n<p class=\"dcr-130mj7b\">She added: \u201cIt is equally impossible not to acknowledge the catalogue of failures to protect a child known for weeks beforehand to be at high risk when a close friend had disappeared to Syria in an identical way and via an identical route.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIt has already been long conceded that the then home secretary, Sajid Javid, who took the precipitous decision in 2019 very publicly to deprive Ms Begum of citizenship, had failed entirely to consider the issues of grooming and trafficking of a school child in London and of the state\u2019s consequent duties.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Pierce said the challenge comes as the current government has made protections for victims of grooming and trafficking a national priority.<\/p>\n<p class=\"dcr-130mj7b\">A Home Office spokesperson said any decision made to protect national security would be robustly defended. They added: \u201cThe government will always protect the UK and its citizens. That is why <a href=\"https:\/\/www.theguardian.com\/uk-news\/shamima-begum\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Shamima Begum<\/a> \u2013 who posed a national security threat \u2013 had her British citizenship revoked and is unable to return to the UK.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The shadow home secretary, Chris Philp, said Begum had \u201cno place\u201d in the UK because of her support for violent extremists.
