{"id":27211,"date":"2026-03-10T08:32:30","date_gmt":"2026-03-10T08:32:30","guid":{"rendered":"https:\/\/microvibenews.com\/?p=27211"},"modified":"2026-03-10T08:32:30","modified_gmt":"2026-03-10T08:32:30","slug":"anthropic-sues-defense-department-over-supply-chain-risk-designation","status":"publish","type":"post","link":"https:\/\/microvibenews.com\/?p=27211","title":{"rendered":"Anthropic sues Defense Department over supply-chain risk designation"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p id=\"speakable-summary\" class=\"wp-block-paragraph\">Anthropic has made good on its <a href=\"https:\/\/techcrunch.com\/2026\/03\/05\/anthropic-to-challenge-dods-supply-chain-label-in-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">promise to challenge<\/a> the Department of Defense (DOD) in court after the agency <a href=\"https:\/\/techcrunch.com\/2026\/03\/05\/its-official-the-pentagon-has-labeled-anthropic-a-supply-chain-risk\/\" target=\"_blank\" rel=\"noreferrer noopener\">labeled it a supply-chain risk<\/a> late last week.<\/p>\n<p class=\"wp-block-paragraph\">The Claude maker filed two complaints against the DOD on Monday in California and Washington, D.C., after a weeks-long conflict between Anthropic and the DOD over whether the military should have unrestricted access to Anthropic\u2019s AI systems. Anthropic had two firm red lines: It didn\u2019t want its technology to be used for mass surveillance of Americans and didn\u2019t believe it was ready to power fully autonomous weapons with no humans making targeting and firing decisions.<\/p>\n<p class=\"wp-block-paragraph\">Defense Secretary Pete Hegseth argued that the Pentagon should have access to AI systems for \u201cany lawful purpose\u201d and that it shouldn\u2019t be limited by a private contractor.<\/p>\n<p class=\"wp-block-paragraph\">A supply-chain risk label is usually reserved for foreign adversaries and requires any company or agency that does work with the Pentagon to certify that it doesn\u2019t use Anthropic\u2019s models. While several private companies are <a href=\"https:\/\/techcrunch.com\/2026\/03\/06\/microsoft-anthropic-claude-remains-available-to-customers-except-the-defense-department\/\" target=\"_blank\" rel=\"noreferrer noopener\">still working with Anthropic<\/a>, the firm is poised to lose <a href=\"https:\/\/www.ft.com\/content\/d8c2969f-2812-44d2-8860-3059fb770bdb\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">much of its business<\/a> within the government.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Anthropic called the DOD\u2019s actions \u201cunprecedented and unlawful\u201d and accuses the administration of <a href=\"https:\/\/techcrunch.com\/2026\/03\/08\/will-the-pentagons-anthropic-controversy-scare-startups-away-from-defense-work\/\" target=\"_blank\" rel=\"noreferrer noopener\">retaliation<\/a> in a complaint filed in San Francisco federal court. \u201cThe Constitution does not allow the government to wield its enormous power to punish a company for its protected speech,\u201d the lawsuit reads.<\/p>\n<p class=\"wp-block-paragraph\">The protected speech Anthropic refers to is its belief about the \u201c<a href=\"https:\/\/techcrunch.com\/2026\/02\/27\/anthropic-vs-the-pentagon-whats-actually-at-stake\/?_thumbnail_id=3098023\" target=\"_blank\" rel=\"noreferrer noopener\">limitations of its own AI services <\/a>and important issues of AI safety,\u201d per the lawsuit. The administration, including Defense Secretary Hegseth and President Trump, have criticized Anthropic and its CEO Dario Amodei as \u201cwoke\u201d and \u201cradical\u201d over the company\u2019s calls for stronger AI safety and transparency measures.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">In the lawsuit, Anthropic argued the government doesn\u2019t have to agree with its views or use its products, but it cannot employ the power of the state to punish or suppress Anthropic\u2019s expression.<\/p>\n<div class=\"wp-block-techcrunch-inline-cta\">\n<div class=\"inline-cta__wrapper\">\n<p>Techcrunch event<\/p>\n<div class=\"inline-cta__content\">\n<p>\n\t\t\t\t\t\t\t\t\t<span class=\"inline-cta__location\">San Francisco, CA<\/span><br \/>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"inline-cta__separator\">|<\/span><br \/>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"inline-cta__date\">October 13-15, 2026<\/span>\n\t\t\t\t\t\t\t<\/p>\n<\/p><\/div>\n<\/p><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Anthropic also argued that \u201cno federal statute authorizes the actions taken here,\u201d claiming the Defense Department\u2019s supply-chain risk designation was issued \u201cwithout observance of the procedures Congress required.\u201d The law generally requires agencies to conduct a risk assessment, notify the targeted company and allow it to respond, make a written national-security determination, and notify Congress before excluding a vendor from federal supply chains.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The firm also accuses the president of operating outside the bounds of the authority granted by Congress when he <a href=\"https:\/\/www.bbc.com\/news\/articles\/cn48jj3y8ezo\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">directed every federal agency<\/a> to immediately stop using Anthropic\u2019s technology, following Amodei\u2019s statement that he would not budge on his hard lines. As a result of the statements made by both President Trump and Secretary Hegseth, the General Services Administration \u2014 the federal agency that manages government contracts and purchasing \u2014 terminated Anthropic\u2019s \u201cOneGov\u201d contract, ending the availability of Anthropic services to all three branches of the federal government.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">\u201cDefendants are seeking to destroy the economic value created by one of the world\u2019s fastest-growing private companies,\u201d the lawsuit reads. \u201cThe Challenged Actions inflict immediate and irreparable harm on Anthropic; on others whose speech will be chilled; on those benefiting from the economic value the company can continue to create; and on a global public that deserves robust dialogue and debate on what AI means for warfare and surveillance.\u201d<\/p>\n<p class=\"wp-block-paragraph\">As part of its complaint, Anthropic asked the court to immediately pause the Defense Department\u2019s designation while the case proceeds and ultimately invalidate and permanently block the government from enforcing it.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">\u201cSeeking judicial review does not change our longstanding commitment to harnessing AI to protect our national security, but this is a necessary step to protect our business, our customers, and our partners,\u201d an Anthropic spokesperson said in a statement. \u201cWe will continue to pursue every path toward resolution, including dialogue with the government.\u201d\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Anthropic filed a separate complaint in the D.C. Circuit Court of Appeals because the federal procurement law allows companies to appeal supply-chain risk designations. The petition asks\u00a0the court to review and overturn the Defense Department\u2019s decision to designate the company a national security supply-chain risk. In the complaint, Anthropic argued the move was unlawful, retaliatory, and improperly executed under federal procurement law.<\/p>\n<p class=\"wp-block-paragraph\"><em>This story has been updated with more details and news that Anthropic has filed a separate lawsuit in the D.C.
