{"id":20382,"date":"2026-02-10T04:25:25","date_gmt":"2026-02-10T04:25:25","guid":{"rendered":"https:\/\/microvibenews.com\/?p=20382"},"modified":"2026-02-10T04:25:25","modified_gmt":"2026-02-10T04:25:25","slug":"raf-tries-to-make-a-mockery-of-the-court-in-medical-expenses-dispute","status":"publish","type":"post","link":"https:\/\/microvibenews.com\/?p=20382","title":{"rendered":"RAF tries to \u2018make a mockery of the court\u2019 in medical expenses dispute"},"content":{"rendered":"<p><\/p>\n<div id=\"textFreeArticle\">\n<p>The Road Accident Fund (RAF) has been accused of attempting to make a mockery of the courts by issuing directives related to past medical expenses of road accident victims \u2013 in conflict with a court interdict \u2013 to evade what the fund\u2019s statute obliges it to do.<\/p>\n<p>This is the view expressed in a judgment by a full court of the Western Cape High Court, which dismissed the RAF\u2019s appeal against an order requiring the fund to pay R350 187.56 in past medical costs, plus interest, to Nicolaas van Wyk, who was injured when his motorcycle collided with a vehicle.<\/p>\n<p>Read:<br \/>New Discovery court ruling: RAF must pay \u2018medical aid\u2019 claimant\u2019s past expenses<br \/>Seven \u2018mistakes\u2019 in RAF past medical expenses high court judgment \u2013 CMS<br \/>RAF \u2018still liable\u2019 for past medical expense payments despite Discovery judgment<\/p>\n<p>Judge James Lekhuleni, with judges Constance Nziweni and Mokgoatji Dolamo concurring, said the RAF must pay the cost of the appeal.<\/p>\n<blockquote>\n<p>\u201cDespite the argument raised relating to its directives having been dismissed by the apex court, the RAF is still soldiering on in its resolve,\u201d the judgment stated.<\/p>\n<\/blockquote>\n<p>Judge Lekhuleni said Van Wyk\u2019s counsel noted that allowing the RAF, which is a government organ, to escape the delictual liability in such a situation would be manifestly inequitable.<\/p>\n<p>Counsel further submitted that the RAF\u2019s directives cannot acquire the force of law and cannot impermissibly conflict with the provisions of the RAF Act.<\/p>\n<p>The judge ruled that the RAF is not entitled to change the prevailing legal position to free itself of its statutory obligations under Section 17 of the RAF Act to pay full compensation to victims of motor vehicle accidents.<\/p>\n<p><strong>Directives in conflict with court orders<\/strong><\/p>\n<p>He said Van Wyk\u2019s counsel also submitted the stratagem by the RAF of issuing subsequent directives on the same subject matter \u2013 to subvert the judgment of Judge Mandla Mbongwe and evade compliance with it \u2013 constitutes unlawful conduct by a public body and cannot be condoned.<\/p>\n<div class=\"visible-sm-block visible-xs-block m1010\">\n<div class=\"ad-container-wrapper\">\n<p>ADVERTISEMENT<\/p>\n<p>CONTINUE READING BELOW<\/p>\n<\/div>\n<\/div>\n<p>\u201cI agree with this proposition. It should be borne in mind that both the Supreme Court of Appeal (SCA) and the Constitutional Court have refused the RAF\u2019s application for leave to appeal.<\/p>\n<blockquote>\n<p>\u201cThus, the RAF\u2019s subsequent directives cannot be issued to overrule the Constitutional Court\u2019s decision,\u201d he said.<\/p>\n<\/blockquote>\n<p>\u201cTo do so would infringe the dignity and authority of the courts envisaged in \u2026 the Constitution and risk rendering our courts impotent and judicial authority a mere mockery.\u201d<\/p>\n<p>The judgment by Mbongwe in October 2022 to an application brought by Discovery Health declared unlawful the RAF\u2019s 12 August 2022 directive refusing to pay past medical expenses on the grounds that those expenses had already been paid by the victim\u2019s medical aid scheme, and interdicted the RAF from implementing the internal directive.<\/p>\n<p>Read:<br \/>State Attorney calls for new Road Accident Fund tribunal<br \/>RAF counter application over \u2018blank cheque\u2019 claims dismissed<br \/>MEC to pay 80% of damages of soldier injured after hitting a pothole<\/p>\n<p>Judge Lekhuleni said the issue relating to the RAF paying past medical expenses for claimants whose claims have been satisfied by their medical aid schemes has been the subject of debate and an avalanche of court decisions in recent times.<\/p>\n<p>He said there is a difference of opinion on whether the RAF should be held liable to pay past medical expenses that have been paid by the medical aid pursuant to injuries sustained in motor vehicle accidents.<\/p>\n<p>The RAF subsequently issued two further directives related to the payment of past medical expenses.<\/p>\n<p><strong>RAF must \u2018desist from this conduct\u2019<\/strong><\/p>\n<p>Discovery Health viewed these subsequent two directives as a refusal to comply with and a circumvention of the Mbongwe order, and demanded the RAF desist from this conduct.<\/p>\n<div class=\"visible-sm-block visible-xs-block m1010\">\n<div class=\"ad-container-wrapper\">\n<p>ADVERTISEMENT:<\/p>\n<p>CONTINUE READING BELOW<\/p>\n<\/div>\n<\/div>\n<p>The RAF refused, insisting that it had the right to issue and implement them, resulting in Discovery Health launching an application for a declarator that, among other things, the RAF was in breach of Mbongwe\u2019s order.<\/p>\n<p>Read\/listen:<br \/>Discovery Health caves to pressure, says it will cover costs of claims overpayments<br \/>Discovery Health asks members to repay thousands after claims processing error<\/p>\n<p>A judgment handed down in December 2024 by a full bench of the High Court in Johannesburg was divided on the reasoning and outcome of Discovery Health\u2019s application, with a majority judgment by Gauteng Division Judge President Dunstan Mlambo and Judge Noluntu Bam, and Judge Ingrid Opperman dissenting.<\/p>\n<p>This judgment is currently pending resolution before the SCA.<\/p>\n<p>Judge Lekhuleni said RAF counsel submitted that the appropriate course would be to leave the decision in respect of payment of past medical expenses to the SCA.<\/p>\n<p>\u201cI respectfully disagree with this proposition.
