{"id":16789,"date":"2026-01-29T06:41:35","date_gmt":"2026-01-29T06:41:35","guid":{"rendered":"https:\/\/microvibenews.com\/?p=16789"},"modified":"2026-01-29T06:41:35","modified_gmt":"2026-01-29T06:41:35","slug":"inquiry-to-call-for-ban-on-globalise-the-intifada-in-nsw-but-only-when-used-to-incite-violence-new-south-wales-politics","status":"publish","type":"post","link":"https:\/\/microvibenews.com\/?p=16789","title":{"rendered":"Inquiry to call for ban on \u2018globalise the intifada\u2019 in NSW \u2013 but only when used to \u2018incite violence\u2019 | New South Wales politics"},"content":{"rendered":"<p><\/p>\n<div>\n<p class=\"dcr-130mj7b\">A New South Wales parliamentary inquiry will recommend <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/dec\/23\/globalise-the-intifada-meaning-translation-palestinian-protest-chant-ban-nsw\" data-link-name=\"in body link\">banning the phrase \u201cglobalise the intifada\u201d<\/a> when it is used to incite violence, but won\u2019t call for banning the statement outright or recommend a ban on phrases such as \u201cfrom the river to sea\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The Labor MP Edmond Atalla, the chair of the inquiry, confirmed the draft recommendations to Guardian Australia ahead of a final closed meeting on Thursday.<\/p>\n<p class=\"dcr-130mj7b\">The NSW opposition, which has described the inquiry as \u201crushed\u201d and having a predetermined outcome, has said the recommendations are confusing and seek to criminalise conduct that was already unlawful.<\/p>\n<p class=\"dcr-130mj7b\">The inquiry will publish its report to the state government on Friday, in time for legislation to be voted on after parliament returns next week. The changes Minns is considering to avoid \u2018unnecessary burden\u2019 from demonstrations&quot;,&quot;elementId&quot;:&quot;8186cb33-aee7-4537-8809-ec668d13e3cc&quot;,&quot;role&quot;:&quot;richLink&quot;,&quot;url&quot;:&quot;https:\/\/www.theguardian.com\/australia-news\/2026\/jan\/29\/designating-domain-protest-site-chris-minns-demonstrations-ntwnfb&quot;},&quot;ajaxUrl&quot;:&quot;https:\/\/api.nextgen.guardianapps.co.uk&quot;,&quot;format&quot;:{&quot;design&quot;:0,&quot;display&quot;:0,&quot;theme&quot;:0},&quot;isInStarRatingVariant&quot;:false}\"\/><\/figure>\n<p class=\"dcr-130mj7b\">The inquiry\u2019s deputy chair, the Labor MP Hugh McDermott, said amendments could be made after the meeting by the Labor-majority committee.<strong> <\/strong>He defended the decision to hold the inquiry over the holiday period, with multiple committee members, including Atalla, overseas for some of it.<\/p>\n<p class=\"dcr-130mj7b\">\u201c[The committee has] been in discussions nearly every single day,\u201d he said.<\/p>\n<p class=\"dcr-130mj7b\">The shadow attorney general, Damien Tudehope, on Thursday said the opposition was \u201cdeeply unimpressed\u201d with the draft recommendation, which he said would \u201cban one slogan but only in circumstances already captured by \u2026 the Crimes Act\u201d.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIf conduct is already unlawful under existing provisions, this recommendation adds nothing except confusion, and risks giving the false impression that other uses are acceptable.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The phrase \u201cglobalise the intifada\u201d, from the Arabic word for uprising or \u201cshaking off\u201d, is used by pro-Palestine supporters in reference to uprisings against Israel that began in 1987 and 2000. Some members of the Jewish community have said it is a call to violence against them.<\/p>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/www.theguardian.com\/email-newsletters?CMP=copyembed&amp;CMP=emailbutton\" data-link-name=\"in body link\"><sub class=\"dcr-130mj7b\">Sign up: AU Breaking News email<\/sub><\/a><\/p>\n<p class=\"dcr-130mj7b\">Both the NSW Jewish Board of Deputies and the Executive Council of Australian Jewry (ECAJ) called for the inquiry to create a new offence for what they called \u201chateful slogans\u201d, including \u201cglobalise the intifada\u201d and \u201cfrom the river to the sea\u201d, but the draft report does not recommend any other phrases be banned.<\/p>\n<p class=\"dcr-130mj7b\">Organisations including Palestine Action Group, the Jewish Council of Australia and the Australian National Imams Council rejected the idea that the phrases were inherently hateful or antisemitic and said a ban would curtail constitutional freedoms.<\/p>\n<p class=\"dcr-130mj7b\">In her submission to this month\u2019s inquiry, the constitutional law expert Prof Anne Twomey said the proposal to ban particular political chants gave rise to \u201cdifficult legal issues in areas of the jurisprudence which have not yet been fully developed\u201d.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIt is unrealistic to expect a parliamentary committee, in such a very short time over the Christmas holiday break, with no oral hearings and presumably few submissions by experts in the field, to come up with the desired constitutionally challenge-proof law.\u201d<\/p>\n<p class=\"dcr-130mj7b\">On Thursday, Twomey told Guardian Australia the recommendation \u201cwould be constitutionally much safer than an outright ban\u201d.<\/p>\n<p class=\"dcr-130mj7b\">NSW already has offences \u2013 93Z and 93ZAA in the NSW Crimes Act \u2013 for inciting violence and inciting hatred on the grounds of race, but McDermott said a new offence for \u201cglobalise the intifada\u201d was needed \u2013 but only where it is used to incite violence.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWe believe that by naming \u2018globalise the intifada\u2019, there is a higher chance of prosecution,\u201d he said.<\/p>\n<p class=\"dcr-130mj7b\">There would be defences for the artistic, academic and educational use of the phrase, although it was not immediately clear how incitement to violence would be determined. On Thursday he reiterated that the inquiry was independent, saying he did not expect legislation to be tabled straight away when parliament resumes next week.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIt\u2019s a parliamentary inquiry. They\u2019ll present their report. He said he was on a humanitarian mission to Namibia with his Mount Druitt church and said his work as chair had not been interrupted. Other committee members have joined previous meetings from overseas.<\/p>\n<p class=\"dcr-130mj7b\">The committee has previously met twice, first on 22 December to set the inquiry\u2019s terms of reference, and then on 13 January after the closing of the deadline for public submissions. McDermott insisted committee members had read all 700 submissions, which he said ranged from one sentence to 30 to 40 pages.<\/p>\n<p class=\"dcr-130mj7b\">It has also been asked to consider existing hate speech laws, as well as \u201cbest practice\u201d from overseas, <a href=\"https:\/\/www.theguardian.com\/australia-news\/2026\/jan\/17\/nsw-state-laws-ban-intifada-protest-slogans-similar-uk-explained\" data-link-name=\"in body link\">including in the UK<\/a>.
