{"id":13288,"date":"2026-01-17T21:33:12","date_gmt":"2026-01-17T21:33:12","guid":{"rendered":"https:\/\/microvibenews.com\/?p=13288"},"modified":"2026-01-17T21:33:12","modified_gmt":"2026-01-17T21:33:12","slug":"judge-rules-feds-in-minneapolis-immigration-raids-cant-detain-or-tear-gas-peaceful-protesters","status":"publish","type":"post","link":"https:\/\/microvibenews.com\/?p=13288","title":{"rendered":"Judge rules feds in Minneapolis immigration raids can\u2019t detain or tear gas peaceful protesters"},"content":{"rendered":"<p><img src=\"https:\/\/fortune.com\/img-assets\/wp-content\/uploads\/2026\/01\/AP26015698957174-e1768664312215.jpg?w=2048\" \/><\/p>\n<p>Federal officers in the Minneapolis area participating in its largest recent U.S.\u00a0immigration enforcement operation\u00a0can\u2019t detain or tear gas peaceful protesters who aren\u2019t obstructing authorities, including when these people are observing the agents, a judge in Minnesota ruled Friday.<\/p>\n<div>\n<p>U.S. District Judge Kate Menendez\u2019s ruling addresses a case filed in December on behalf of six Minnesota activists. The six are among the thousands who have been observing the activities of Immigration and Customs Enforcement and Border Patrol officers enforcing the Trump administration\u2019s immigration crackdown in the Minneapolis-St. Paul area since last month.<\/p>\n<p>Federal agents and demonstrators have\u00a0repeatedly clashed\u00a0since the crackdown began. The confrontations escalated after an\u00a0immigration agent fatally shot Renee Good\u00a0in the head on Jan. 7 as she drove away from a scene in Minneapolis, an incident that was\u00a0captured on videofrom several angles. Agents have\u00a0arrested or briefly detained\u00a0many people in the Twin Cities.<\/p>\n<p>The activists in the case are represented by the American Civil Liberties Union of Minnesota, which says government officers are violating the constitutional rights of Twin Cities residents.<\/p>\n<p>After the ruling, U.S. Department of Homeland Security Assistant Secretary Tricia McLaughlin issued a statement saying her agency was taking \u201cappropriate and constitutional measures to uphold the rule of law and protect our officers and the public from dangerous rioters.\u201d<\/p>\n<p>She said people have assaulted officers, vandalized their vehicles and federal property, and attempted to impede officers from doing their work.<\/p>\n<p>\u201cWe remind the public that rioting is dangerous \u2014 obstructing law enforcement is a federal crime and assaulting law enforcement is a felony,\u201d McLaughlin said.<\/p>\n<p>The ACLU didn\u2019t immediately respond to requests for comment Friday night.<\/p>\n<p>The ruling prohibits the officers from detaining drivers and passengers in vehicles when there is no reasonable suspicion they are obstructing or interfering with the officers.<\/p>\n<p>Safely following agents \u201cat an appropriate distance does not, by itself, create reasonable suspicion to justify a vehicle stop,\u201d the ruling said.<\/p>\n<p>Menendez said the agents would not be allowed to arrest people without probable cause or reasonable suspicion the person has committed a crime or was obstructing or interfering with the activities of officers.<\/p>\n<p>Menendez is also presiding over a lawsuit filed Monday by the state of Minnesota and the cities of Minneapolis and St. Paul seeking to suspend the enforcement crackdown, and some of the legal issues are similar. She declined at\u00a0a hearing Wednesday\u00a0to grant the state\u2019s request for an immediate temporary restraining order in that case.<\/p>\n<p>\u201cWhat we need most of all right now is a pause. The temperature needs to be lowered,\u201d state Assistant Attorney General Brian Carter told her.<\/p>\n<p>Menendez said the issues raised by the state and cities in that case are \u201cenormously important.\u201d But she said it raises high-level constitutional and other legal issues, and for some of those issues there are few on-point precedents.
